Terms and Conditions of Agreement
345 Concrete Inc.
These Terms and Conditions are incorporated into and made part of any contract, estimate, proposal, or agreement entered into between 345 Concrete Inc. (“Contractor”) and the Customer/Property Owner (“Owner”) for concrete construction services.
CSLB Notice
The Contractors State License Board (CSLB) is the state consumer protection agency that licenses and regulates construction contractors.

Use only licensed contractors. If you file a complaint against a licensed contractor within the legal deadline (generally four years), the CSLB has authority to investigate the complaint.
If you use an unlicensed contractor, the CSLB may not be able to help resolve your complaint and your only remedy may be in civil court.
Scope of Work
Contractor agrees to furnish labor, materials, equipment, and supervision necessary to perform the work described in the Scope of Work section of the contract or proposal.
Any work not specifically listed shall require a written Change Order.
Owner Responsibilities
- Provide clear access to the work site during normal working hours
- Provide water, electrical power, and utilities unless otherwise stated
- Remove or protect vehicles, furniture, landscaping, and personal property
- Identify property boundaries and underground utilities
Contractor is not responsible for:
- Underground utilities not disclosed
- Sprinkler lines
- Landscaping within work area
- Decorative concrete not installed by Contractor
- Personal property not removed
Concrete Conditions
Concrete is a natural material. The following are normal and not defects:
- Color variations
- Hairline cracks
- Texture variations
- Minor settling or expansion
- Differences between pours
Cracking may occur due to:
- Soil movement
- Temperature changes
- Moisture variations
- Structural movement
- Improper curing
Unforeseen Conditions
Hidden conditions such as unstable soil, drainage issues, or buried debris may require additional work, handled via Change Orders.
Delays
Contractor is not responsible for delays caused by:
- Weather
- Material shortages
- Permit delays
- Utility delays
- Labor shortages
- Acts of God or regulations
Permits
Permit fees and related costs are the responsibility of the Owner unless otherwise stated.
Change Orders
All modifications must be in writing and signed by both parties, including cost and schedule changes.
Payment Terms
Payments follow the contract schedule. Down payment shall not exceed $1,000 or 10% of contract price (whichever is less).
Right to Stop Work
Contractor may stop work if payments are not made on time.
Mechanics Lien Warning
Unpaid parties may file a lien against your property. Owner is encouraged to request lien releases.
Warranty
Workmanship is warranted for 365 days. Warranty excludes normal concrete behavior, misuse, or external damage.
Limitation of Liability
Contractor is not liable for indirect or consequential damages. Liability is limited to the contract amount.
Subcontractors
Contractor may use licensed subcontractors.
Dispute Resolution
Disputes will go through mediation, then binding arbitration if necessary.
Insurance
- General Liability Insurance
- Workers’ Compensation Insurance
Cancellation
Owner may cancel within 3 business days if work has not started. Costs may apply after work or material purchase begins.
Site Access
Access required Monday – Friday, 7:00 AM – 5:00 PM.
Jobsite Safety
- Keep children and pets away
- Avoid work zones
- Follow safety instructions
Entire Agreement
This document represents the full agreement. Changes must be in writing.
Acceptance
By signing, Owner agrees to all terms and conditions stated above.
